The Role and the Organisation:

Our client is one of the world's leading wholesale banks, with 10+ years of operations in Australia. This is a critical role supporting the Senior Legal Counsel, looking after all legal, commercial and regulatory matters for all branches, departments and products across Australia.


Responsibilities:
  • General agreements: Drafting, review and negotiation of various types of commercial contracts (including for procurement, operations, non-disclosure agreements).
  • Wholesale banking transactions: Provide internal legal assessment of transaction legal service requirements, determine if external legal needs to be engaged or consulted, resolve legal issues as they arise and escalate. Support business departments in their commercial negotiations and (where required) engage with other party’s legal advisors to resolve technical legal issues.
  • New products, services, projects: Provide legal advice on new products, services and special projects, including identifying regulatory and business risk implications.
  • Standard documentation: Development and review of standard contract templates, product terms and conditions, disclaimers etc.
  • Monitoring of legal & regulatory changes: Assist in monitoring, research and advices on change in case law, legislation and regulations.
  • External legal liaison: Engage with local external legal advisors on the panel.
  • Legal and statutory notices: Assist in the management of handling various types of notices received.
  • Legal operations: Assist Senior Legal Counsel in the day-to-day running of the internal legal function, including reporting, maintenance of advice and precedent library, updating of registers maintained by internal legal function.

Requirements:
  • 5+ years post-qualification experience in Australia (preferably in Financial Services).
  • Tertiary qualifications in law and hold a current Australian Practising Certificate.
  • Experience in drafting, advising and negotiating various types of general commercial contracts.
  • Experience advising on banking and finance legal matters in Australia is highly desirable (preferably in wholesale lending).
  • Sound knowledge in legal and regulatory requirements applicable to foreign ADIs.
  • Ability to work within a small team independently and confidently with minimal supervision.
  • Ability to manage multiple tasks and collaborate with cross-functional stakeholders.
